MCM Freight Brokerage: Terms and Conditions

 

These Terms and Conditions ("Terms") govern the use of freight brokerage services provided by MCM Freight Brokerage ("MCM"). By engaging MCM's services, you agree to be bound by these Terms. Please read them carefully before utilizing our services.

1. Service Description:

  • MCM acts as a freight broker, facilitating the transportation of goods by contracting with carriers on behalf of our customers.

  • Our services include but are not limited to arranging transportation, providing documentation, and coordinating logistics.

 

2. Service Limitations:

  • MCM does not own or operate transportation vehicles. We act as an intermediary between customers and carriers.

  • While we strive to select reliable carriers, MCM does not guarantee the performance or actions of third-party carriers.

 

3. Booking and Payments:

  • Customers must provide accurate shipment details and agree to MCM's quoted rates before booking.

  • Payment terms are specified in each individual agreement. Failure to adhere to payment terms may result in additional fees or suspension of services.

 

4. Liability:

  • MCM is not liable for any loss, damage, or delay of goods during transportation, except where caused by our gross negligence or willful misconduct.

  • Customers are responsible for insuring their shipments and should seek appropriate coverage as necessary.

 

5. Claims and Disputes:

  • MCM will manage all claims related to freight transportation services provided by the company.

  • Claims must be initiated by the Customer within 15 days from the date of delivery of the shipment.

  • Claim Submission:

  • To initiate a claim, the Customer must notify MCM in writing within the specified timeframe.

  • The Customer must provide detailed information regarding the nature of the claim, including any supporting documentation or evidence.

  • Proof of Payment:

  • The Customer must provide proof of payment for the freight transportation services in question as part of the claim submission process.

  • Proof of payment may include invoices, receipts, or other relevant financial documentation.

  • Claim Assessment:

  • MCM will assess the validity of the claim based on the information provided by the Customer and any additional investigation deemed necessary.

  • MCM reserves the right to request additional documentation or information from the Customer to support the claim assessment process.

  • Resolution Process:

  • Upon completion of the claim assessment, MCM will communicate its decision to the Customer in a timely manner.

  • If the claim is deemed valid, MCM will work with the Customer to determine an appropriate resolution, which may include reimbursement, credit, or other forms of compensation.

  • The resolution of the claim will be at the discretion of MCM and will be final.

  • Limitations and Exclusions:

  • MCM shall not be liable for claims arising from circumstances beyond its control, including but not limited to acts of nature, government regulations, or actions of third-party carriers.

  • MCM shall not be liable for claims resulting from the Customer's failure to comply with the terms and conditions of the freight transportation agreement.

 

6. Confidentiality:

  • MCM agrees to maintain the confidentiality of customer information and will not disclose sensitive information to third parties without consent, except as required by law.

 

7. Compliance:

  • Customers and carriers must comply with all applicable laws, regulations, and industry standards during the transportation process.

  • MCM reserves the right to refuse service to any customer or carrier that violates legal or ethical standards.

 

8. Termination of Services:

  • MCM reserves the right to terminate services or refuse future bookings at our discretion, particularly in cases of non-payment, breach of contract, or unethical behavior.

 

9. Amendments:

  • MCM may update these Terms from time to time without prior notice. It is the customer's responsibility to review the Terms periodically for any changes.

 

10. Governing Law:

  • These Terms and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflicts of law provisions.
